To enter customers simply need to purchase any one of the ‘Destra phones’ – Sony Ericsson W380 or W580 handset - either prepaid or postpaid.

The Destra phones are the Sony Ericsson W380 and W580 handsets that are preloaded with music from Destra.

  1. What do I have to do to enter?

To enter all you need to do is purchase a ‘Destra phone’ between the period (Aug 8th – Sept 14th). Fill out the entry form at the dealer store of purchase and submit your entry form into the box provided at the dealer outlet.

  1. How many times can I enter?

Each ‘Destra phone’ purchased entitles you to one (1) entry.

  1. What do I win?

The Grand prize winner will receive:-

  • A trip for two (2) to Miami between October 9th – 13th, 2008 to see Destra perform in one concert being held during the period.
  • Hotel accommodation – double occupancy accommodations at the Hyatt Regency Hotel Miami.

  1. Can I give my prize to someone else if I win?

No. You will not be able to give your prize to someone else as the prizes are non-transferable.

  1. Will Digicel or Sony Ericsson provide me with a US Visa if I am selected the winner but I do not have this?

No. The winner is solely responsible for making any necessary arrangements to obtain a valid passport and/or United States visa.

  1. How will winners be contacted?

The winner will be contacted via phone.

  1. If I am selected the winner, what do I need to present when collecting my prize?

The winner must walk with their valid passport and their companion’s when collecting the prize. These passports MUST have valid US visas.

TERMS AND CONDITIONS

Win a trip for two (2) to Miami from October 9-13, 2008 to see Destra in concert (hotel accommodation and spending money included)

Promotion

  • Digicel will be offering for sale Sony Ericcson W380 and W580 phones (both prepaid and postpaid) preloaded with music from Destra (“Destra phones”).
  • When a subscriber purchases a Destra phone from any Digicel partner dealer he/she will be eligible for one (1) entry per purchase in a random drawing for the grand prize set out below to be held on September 17, 2008 (“the promotion”). The draw will be supervised by independent auditors PriceWaterhouseCoopers.
  • Entry forms will be available from partner dealers upon purchase and must be placed by the subscriber in the relevant entry box at the partner dealer outlet of purchase. Participants must enter their Digicel number as their contact number and hereby agree that that number will be the only means by which Digicel may contact them should they win the grand prize. If Digicel is unable to contact the person named on the first entry form drawn within 24 hours of the drawing, then Digicel has the option to draw successive entry forms until a winner is contacted.
  • The promotion will run from August 8, 2008 to September 14, 2008 (or while stocks last, whichever is earlier) and is approved by the National Lotteries Control Board.
  • The grand prize will be a trip for two (2) to Miami between October 9-13, 2008 together with tickets for two (2) to see Destra perform at one concert being held during that period (“the grand prize”). Also included in the grand prize will be hotel accommodation for two (2) for that period together with USD$500 each in spending money. All travel arrangements will be organized by Sony Ericcson and/or its agent in Trinidad and Tobago. A representative from Sony Ericcson will accompany the winners to and from Miami. The winners will stay in double occupancy accommodations at the Hyatt Regency Hotel Miami and air travel will be on American Airlines. Restrictions will apply. Transport to and from the hotel and airport as well as transport to and from the hotel and the concert venue will be included in the grand prize.
  • Prizes are not transferable and subscribers are solely responsible for making any necessary arrangements to obtain a valid passport and/or United States visa.
  • The winners agree to make themselves available to representatives of Sony Ericcson and/or Digicel for promotional, marketing or publicity activities or events at the concert in Miami and at such other times as reasonably required by those representatives.

To enter and be eligible to win

  • You must be a legal resident of Trinidad & Tobago
  • You must be 18 years of age or older
  • You must have a Digicel prepaid or postpaid phone
  • You and your travelling companion must both be holders of valid passport and (if necessary) a United States visa on or before September 17, 2008

The following terms apply to both Prepaid & Postpaid Customers

  • Persons in any of the following categories are NOT eligible to participate or win the grand prize
    • Any person who at any time on or after August 8, 2008 was or is a director, officer, employee, agent of Digicel Trinidad & Tobago Limited or its parent, subsidiary, or other affiliated companies, partner dealers, franchisees or service agencies or independent contractors
    • Individuals engaged in the development, production, advertising or distribution of materials for the promotion (collectively the ”Promotion Entities”) and
    • Persons who are or purport to be immediate family members (defined as a biological parent, step-mother, step-father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories (regardless of where they live) or any persons who reside in the same household as any person in any of the preceding categories (i.e. who have lived in the same household for at least three (3) of the twelve (12) months preceding August 8, 2008 whether those persons are related or not).

Conditions of Entry

  1. Participants acknowledge that compliance with these Terms and Conditions including all eligibility requirements is a necessary pre-condition to the grand prize being awarded to them. For removal of all doubt, participants who have not complied with these Terms and Conditions are subject to disqualification and are obliged to return the grand prize to Digicel should he/she be selected as the winner (or alternatively he/she will be liable to repay to Digicel an amount equivalent to the value of the grand prize).
  2. Selected winners may be required to provide Digicel with proof that he/she is the authorized account holder/owner of the mobile number associated with the selected entry and will be required to sign a Statutory Declaration of Eligibility/Prize Acceptance and Release within two (2) days of notification that they have won the grand prize.
  3. Digicel reserves the right in its sole discretion to cancel, modify or suspend this promotion at any time, if any errors, omissions or other causes beyond the control of Digicel corrupt the administration, security, integrity or proper conduct of the promotion.
  4. Digicel, its Partner Dealers and the Promotion Entities are not responsible or liable for any problems that may arise, including but not limited to any errors of any kind in connection with the promotion (whether human, mechanical, clerical, electronic, or technical in nature), the incorrect or inaccurate record of information on the entry forms, the failure to record or misplacing any information and/or entry forms in connection with the promotion and/or any errors or omissions with respect to the printing, collection, storage and transport of the entry forms for the promotion.
  5. Any attempt by an participant or other individual to deliberately undermine the legitimate operation of the promotion, including but not limited to any fraudulent claims, may be in violation of criminal and/or civil laws in Trinidad and Tobago.
  6. Should such an attempt be made, Digicel reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution.
  7. Participants engaging in or reasonably suspected of engaging in any of the foregoing activities may be disqualified and shall automatically forfeit the grand prize won.
  8. All prizes are subject to change at the sole discretion of Digicel and must be accepted as awarded. In no event will Digicel be obliged to award or be liable for more than the items defined as the grand prize. The winner shall be solely responsible for any taxes, insurance or any other expenses associated with the grand prize other than those expressly stated as included in the grand prize.
  9. In the event of any conflict between these Terms and Conditions and any promotional details contained in point of sale, television and print, advertising, promotional packaging and other promotional media (“Promotion Materials”) the details of the promotion set forth in these Terms and Conditions shall prevail.
  10. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
  11. Digicel employees are not authorized to waive, modify or amend any provision or provisions of these Terms and Conditions in any manner whatsoever.
  12. All participants agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel and consent to the use and disclosure by Digicel in any form of media of their names, likenesses and/or general areas of residence without compensation.
